Terms of Service

By clicking “Sign up”, ticking the acceptance box, or otherwise accessing the Service, you confirm that:

• You are at least 18 years of age
• You have the legal capacity to enter into a binding contract
• You have read and agree to be bound by these Terms and our Privacy Policy
• You have read and agree to our Refund Policy

If you do not agree, do not use the Service.

The Service is provided by ERPCV FZE, a Free Zone Establishment registered in the United Arab Emirates. Our affiliate ERPCV LLC operates the United States presence. Unless otherwise stated, your contract is with ERPCV FZE.

ERPCV provides:

• Free tools: an ATS Score Checker and an Application Tracker, available without an account.
• Career Pack: a one-time paid service ($10.99 USD as of the effective date) that generates six career documents from a CV you upload: Executive CV, Project Portfolio, Cover Letter, Reference Sheet, LinkedIn outreach messages, and Interview prep.
• Career Guidance: an optional paid 30-minute video session with a senior consultant ($100 USD as of the effective date).

Document generation uses third-party AI infrastructure (Anthropic's Claude). Output is generated from the content you provide. We do not warrant that the output is suitable for any specific purpose, will produce job offers, or will be accepted by any specific recruiter or applicant tracking system. The Service is a tool; the responsibility for how you use the output rests with you.

You are responsible for:

• Providing accurate registration information and keeping it current
• Maintaining the confidentiality of your password and any session credentials
• All activity that occurs under your account
• Promptly notifying us at hello@erpcv.com of any unauthorized use

One person, one account. Account sharing is not permitted.

You may delete your account at any time by emailing hello@erpcv.com. See our Privacy Policy for what data is retained after deletion.

You retain all ownership rights in the CV, profile information, job descriptions, and any other content you submit to the Service (“Your Content”).

By submitting Your Content, you grant ERPCV a limited, non-exclusive, worldwide, royalty-free licence to host, copy, process, transmit, and display Your Content only for the purpose of providing the Service to you: including sending it to our AI sub-processor (Anthropic) to generate your documents, storing the generated output in your account, and emailing it to you.

We will not use Your Content to train AI models, sell or share it with third parties for marketing, or use it for any purpose other than delivering the Service.

You warrant that:

• You have all rights necessary to submit Your Content
• Your Content is accurate to the best of your knowledge
• Your Content does not infringe any third party's intellectual property, privacy, or other rights
• Your Content does not contain unlawful, defamatory, or harassing material

Paid services are billed in US dollars via Stripe at the price displayed on the checkout page. All prices include applicable VAT or sales tax where required by law; otherwise, you are responsible for any taxes due in your jurisdiction.

Refunds are governed by our Refund Policy. In summary:

• The Career Pack is delivered digitally and consumed immediately on payment. Refunds are not available once documents have been generated and made available to you.
• Consumers resident in the EU/EEA or UK have a 14-day right of withdrawal under EU Directive 2011/83 unless they explicitly waive it at checkout. By proceeding with checkout, you waive that right.
• Refunds for failed delivery or technical non-performance are available, email hello@erpcv.com within 14 days.

You agree not to:

• Use the Service for any unlawful purpose, or in violation of any applicable law or regulation
• Upload CVs or content that is not yours, or that contains information about third parties without their consent
• Use the Service to generate documents you intend to misrepresent as someone else's work
• Attempt to bypass authentication, payment gates, rate limits, or any other access controls
• Reverse engineer, scrape, or systematically extract content from the Service
• Use the Service to send spam, phishing, or other malicious communications
• Interfere with or disrupt the Service or the servers and networks that host it
• Submit malicious code (viruses, worms, malware) in any uploaded file
• Resell, sublicense, or commercially exploit the Service without our prior written permission
• Use the Service in any way that could damage, disable, overburden, or impair it

We reserve the right to suspend or terminate accounts that violate these provisions, with or without notice, and to refuse service to anyone at our discretion.

The Service, including all software, design, text, logos, layouts, prompts, and other materials (other than Your Content), is owned by ERPCV or its licensors and protected by intellectual property laws. We grant you a limited, non-transferable, revocable licence to access and use the Service for its intended personal or business purpose.

You own the documents we generate for you from Your Content. ERPCV does not claim ownership over your Career Pack output. You may use, edit, share, and distribute those documents without restriction or attribution.

The Service integrates with third-party providers including Stripe (payments), Supabase (database and authentication), Anthropic (AI generation), Resend (email), Vercel (hosting), and Cal.com (consultation booking). Your use of these features is also subject to the third party's own terms. ERPCV is not responsible for the acts or omissions of these third parties.

The Service is provided “as is” and “as available”. To the maximum extent permitted by applicable law, ERPCV disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted or error-free operation.

ERPCV does not warrant that the Service will produce any specific career outcome, including but not limited to interview invitations, job offers, salary improvements, or applicant-tracking-system pass rates. Career success depends on factors outside our control.

AI-generated content can contain inaccuracies. You are responsible for reviewing all generated documents for factual accuracy before submitting them to any third party.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable consumer protection law.

To the maximum extent permitted by applicable law, ERPCV (including its officers, directors, employees, and agents) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunity, arising out of or in connection with the Service, even if advised of the possibility of such damages.

Our total aggregate liability arising out of or in connection with the Service, regardless of the cause of action (whether in contract, tort, statute, or otherwise), is limited to the greater of (a) the total amount you paid to ERPCV in the 12 months preceding the event giving rise to the claim, or (b) USD 100.

This limitation does not apply to liability arising from our gross negligence, willful misconduct, or any liability that cannot be excluded by law (including consumer rights and product liability in the EU/UK).

You agree to defend, indemnify, and hold harmless ERPCV from and against any claim, demand, damage, loss, liability, or expense (including reasonable legal fees) arising out of or related to:

• Your breach of these Terms
• Your Content, including any claim that it infringes third-party rights or violates law
• Your use of the Service in violation of applicable law

This indemnity does not apply to the extent a loss is caused by our gross negligence or willful misconduct, and it does not apply to consumers acting outside their trade or profession to the extent excluded by applicable consumer protection law.

You may stop using the Service at any time and delete your account by emailing hello@erpcv.com.

We may suspend or terminate your access, with or without notice, if you breach these Terms, use the Service in a way that exposes us to legal risk, or if we are required to do so by law. Upon termination, sections of these Terms that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, and governing law) will continue to apply.

We may revise these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. For material changes that affect your rights, we will notify you by email at least 30 days before the change takes effect. Your continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

These Terms and any dispute arising out of or in connection with them are governed by the laws of the United Arab Emirates and, where applicable, the laws of the Free Zone in which ERPCV FZE is registered, without regard to conflict-of-laws principles.

The courts of the United Arab Emirates have exclusive jurisdiction over any dispute, except that:

• Nothing in this section prevents consumers from bringing proceedings in the courts of their country of residence where required by applicable consumer protection law (including EU consumer rights).
• We may bring proceedings in the country where you are domiciled to enforce any judgment or recover any unpaid amounts.

Entire agreement

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and any DPA, form the entire agreement between you and ERPCV concerning the Service.

Severability

If any provision is held unenforceable, the remaining provisions remain in full force.

No waiver

Our failure to enforce any provision does not constitute a waiver of that or any other provision.

Assignment

You may not assign these Terms without our prior written consent. We may assign them to an affiliate or to a successor in connection with a merger, acquisition, or sale of assets.

Force majeure

Neither party is liable for any failure or delay caused by events beyond reasonable control (natural disasters, war, terrorism, civil unrest, governmental action, internet outages, third-party infrastructure failures).

Notices to ERPCV should be sent to hello@erpcv.com. We may send notices to you via the email address associated with your account.

Language

These Terms are written in English. Any translation is provided for convenience only; the English version prevails in case of conflict.
